Is CBD Legal in All 50 States (2019)?

 

Interested in trying CBD? It’s common for people to question CBD since it is new and exciting before actually trying it out.  People have different reasons why they should use CBD for their personal wellness, but the one of the most commonly asked questions is “is CBD actually legal here in the United States?”

 

Short answer: Yes! It is legal in all 50 states (2019).

Hemp-derived is legal in all 50 states while marijuana-derived CBD is not federally legal.  It is important to know your CBD products are hemp-derived.  Hemp-derived CBD is legal under the 2018 Farm Bill that has less than 0.3% Delta-9 THC.  Marijuana-derived CBD is not federally legal because marijuana contains high levels of THC>

Let’s dive into the specifics on why something that comes from the marijuana plant is legal and safe to use…. Cannabidol, “CBD”, is just one of the various cannabinoids in the marijuana plant.  You may be familiar with the most common cannabinoid in marijuana called, “THC”, which is psychoactive and causes that “high” feeling. However, the cannabinoid, “CBD”, is non-psychoactive and does not make you feel “stoned” or “high”.  CBD has been taking the United States by storm for different reasons than the mainstream THC products you may see in the news headlines. Through research, CBD has shown that it may help significantly with conditions such as anxiety, depression, addiction, inflammation, arthritis, stress, and nausea.  The list of how CBD can help you in your everyday life goes on and on.

 

How is this CBD cannabinoid legal though?  It still comes from marijuana right?

 

It is not very hard to find CBD products in the marketplace today in the United States.  The Brightfield Group, cannabis industry analysts, are predicting the CBD industry alone to hit $22 billion by 2020… There are so many different CBD products available on the market today so that you can get your daily CBD dosage including pain relief salves, lotion, muscle gel, vape pens, flower, gummies, oil drops, etc. CBD has been shown through research to be safe for consumption and very beneficial for personal wellness.  

The Farm Bill of 2018 that recently passed now makes it completely legal to sell CBD and amends the term, “marijuana”, which is under the 1972 Controlled Substance Act, by discluding the hemp plant containing less than 0.3% THC.  

 

How is CBD legal vs. illegal under the Controlled Substance Act?

 

CBD is both found in the hemp and cannabis plant.  CBD sourced from both types of plants are the exact same… The only difference was the legality of where it is derived from.  When CBD is sourced from the hemp plant, there is less than 0.3% THC, which is the type of CBD that is completely legal to purchase and sell.  However, when CBD is derived from the cannabis plant, it became questionable because of the plant’s illegal status under the 1972 Controlled Substance Act.  Understanding where your chosen CBD products are derived from will help you determine whether it is legal or not depending on your state laws.
